Terms & Conditions

This page explains the German text below in plain English. It is not a translation and it is not the legal text: the German version is the only legally binding one, and where the two differ, the German text governs.

§ 1 Scope

These terms apply to every contract between the provider named in § 1 of the German text and a customer for the use of Thellma Intelligence. A customer's own terms apply only if the provider expressly agrees to them in writing.

§ 2 The service

The service analyses and summarises newsletter emails automatically. It receives and stores emails forwarded to it, analyses and summarises their content with AI, and creates and sends personalised briefing emails. The provider may extend or change the features at any time.

§ 3 AI-generated summaries

Summaries are generated by AI and are not legal advice. The provider does not guarantee that they are complete, correct or up to date. You must check anything relevant to you against the original sources before relying on it, and the service does not replace advice from a lawyer or other professional.

§ 4 Your obligations

You may only forward emails you are entitled to receive, must not use the service for unlawful purposes, and must keep your login details secret. You must not forward content that breaks the law, infringes someone else's copyright or contains malware.

§ 5 Liability

The provider is fully liable only for injury to life, body or health, and for intent and gross negligence. For slight negligence it is liable only for breaches of essential contractual duties, and only up to the typical, foreseeable damage. It is not liable for damage from using AI-generated summaries that you did not check against the original sources.

§ 6 Term and termination

The contract runs indefinitely. Either side can end it with notice to the end of a month, under the notice period set out in § 6 of the German text. Either side can also end it at any time for good cause.

§ 7 Data protection

How personal data is processed is explained in the privacy policy.

§ 8 Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. § 8 of the German text also names the court with jurisdiction over disputes, where the law allows such a choice.

§ 9 Severability

If one provision is invalid, the rest remain valid. The invalid provision is replaced by a valid one that comes closest to its economic purpose.
